These Terms of Service ("Terms") govern your access to and use of the website, application, and services (collectively, the "Platform") provided by the Platform operator ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.
1. User-Generated Content
The Platform allows users to submit reviews, comments, and other content regarding residential and commercial properties ("User Content"). You understand and agree that:
- You alone are responsible for the User Content you submit.
- User Content does not reflect our views and is not endorsed by us.
- We do not pre-screen or regularly monitor User Content.
- We assume no responsibility for User Content that may be offensive, inaccurate, defamatory, misleading, or otherwise objectionable.
Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), as interpreted by California courts, the Platform and its operators shall not be treated as the publisher or speaker of any User Content and are not liable for any statements, representations, or content provided by users of the Platform.
2. User Conduct
You agree not to:
- Submit User Content that is false, misleading, libelous, obscene, harassing, or discriminatory;
- Use the Platform for illegal purposes or violate any laws, including California state laws and local ordinances;
- Infringe on third-party rights, including intellectual property or privacy rights.
We reserve the right to suspend or terminate your access to the Platform in the event of a violation of these Terms or conduct harmful to others or to the Platform.
3. Limitation of Liability
YOU EXPRESSLY AGREE THAT WE ARE NOT RESPONSIBLE FOR ANY USER-GENERATED CONTENT, INCLUDING CONTENT THAT MAY BE OFFENSIVE, DEFAMATORY, OR OTHERWISE LEGALLY ACTIONABLE UNDER STATE OR FEDERAL LAW.
4. California Civil Code Section 1542 Waiver
You acknowledge and agree that by agreeing to these Terms, you are waiving certain legal protections under California Civil Code Section 1542, which states:
To the extent permitted by law, you waive all rights under this section with respect to claims arising from use of the Platform.
5. Disclaimer of Warranties
The Platform and all content available through it are provided "AS IS" and "AS AVAILABLE" without warranty of any kind. We disclaim all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability;
- Fitness for a particular purpose;
- Non-infringement;
- Accuracy, reliability, or completeness of content.
6. Modifications to Terms
We reserve the right to modify or replace these Terms at any time. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
7. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions. Any legal action arising out of or relating to these Terms shall be filed and maintained exclusively in a state or federal court located in San Diego County, California.
